Important Customer Agreements (Please Read Carefully)
  1. All jobs over CCO (Payment of balance in full at time of order/installation, additions or set up, etc.) require a separate quotation and approval by AZ Sunset Steel Structures & Carports.
  2. ASSSC is not responsible for conditions of the site, including underground utilities, rock, tree, or other obstacles.
  3. It is the customer's responsibility to verify property lines, easements, and building restrictions.
  4. Some sites need local ordinances may require a building permit; we are not liable for any inspection fee for obtaining any required permits or approvals.
 
  1. ASSSC is not responsible for damage caused to unwanted or unknown utilities.
  2. If a take-accept purchase, a copy of your tax exemption certificate MUST be attached to this order.
  3. This order is valid for 14 days from the date above.
  4. All prices are subject to change without notice.

Terms & Conditions — AZ Sunset Steel Structures & Carports

1. Site Preparation

Buyer is solely responsible for ensuring that the installation site is properly prepared, level, and accessible prior to installation. Any additional labor, delays, or rescheduling costs resulting from an unprepared site may be charged to Buyer.

2. Permits and Authorizations

Buyer is solely responsible for obtaining all permits, approvals, inspections, HOA approvals, zoning approvals, and any other governmental authorizations required for the installation of the structure.

3. Underground Utilities

Buyer is responsible for identifying and marking all underground utilities, including water lines, electrical lines, gas lines, septic systems, irrigation systems, and any other underground structures prior to installation. AZ Sunset Steel Structures & Carports shall not be responsible for damages to unmarked underground utilities.

4. Lead Times

Estimated production, delivery, and installation dates are estimates only and may be affected by weather conditions, permit delays, material availability, labor availability, transportation issues, and other circumstances beyond the Company's control.

5. Payment Terms

A deposit may be required at the time of order. The remaining balance is due in full upon delivery and/or installation unless otherwise agreed to in writing. Failure to make payment may result in suspension of delivery, installation, warranty coverage, or repossession where permitted by law.

6. Cancellation Policy

Deposits are non-refundable once production has begun or materials have been ordered. Custom engineered plans, permit drawings, and special-order materials are non-refundable.

7. Modifications

Any modifications, additions, alterations, relocation, or changes made after installation that have not been approved in writing may void applicable warranties.

8. Warranties

Manufacturer warranties apply according to the manufacturer's published warranty guidelines. Warranty coverage does not apply to damage caused by misuse, neglect, acts of nature, improper anchoring, unauthorized modifications, flooding, fire, vehicle impact, or other events beyond normal use.

9. Limitation of Liability

AZ Sunset Steel Structures & Carports shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the purchase, delivery, installation, or use of the structure. The Company's maximum liability shall not exceed the amount paid by Buyer under this Agreement.

10. Governing Law

This Agreement shall be governed by and construed under the laws of the State of Arizona.

11. Engineering Plans and Third-Party Services

AZ Sunset Steel Structures & Carports may assist customers in obtaining engineered drawings, site-specific plans, calculations, and related engineering services through independent third-party engineering firms. Buyer acknowledges that engineering services are performed by independent companies and are not directly provided by AZ Sunset Steel Structures & Carports. Engineering fees, revision fees, permit corrections, design modifications, processing times, and approval times are determined solely by the engineering provider. AZ Sunset Steel Structures & Carports does not guarantee engineering completion dates or permit approval dates and shall not be held liable for delays, corrections, revisions, or rejections arising from engineering services. All engineering fees are non-refundable once work has commenced.

12. Permitting and Government Approvals

Buyer is solely responsible for verifying local building requirements, zoning requirements, setback requirements, HOA requirements, and permit requirements prior to purchase. The Company may provide assistance during the permitting process; however, permit approval remains solely at the discretion of the applicable authority. The Company shall not be liable for permit delays, denials, additional requirements, engineering revisions, inspections, or governmental fees.

13. Design Changes

Any modifications requested after an order has been approved may result in additional charges, revised engineering fees, revised lead times, or cancellation of previously approved pricing. No modifications shall be considered valid unless confirmed in writing by AZ Sunset Steel Structures & Carports.

14. Special Order Materials

Custom materials, special-order components, engineered designs, custom colors, custom dimensions, and non-standard products are non-refundable once production or ordering has begun.

15. Weather and Installation Delays

Installation dates are estimates only and may be affected by weather conditions, high winds, rain, material shortages, labor availability, equipment issues, road closures, or permit delays. AZ Sunset Steel Structures & Carports shall not be liable for damages, losses, or expenses resulting from installation delays.

16. Customer Access and Installation Conditions

Buyer shall provide safe and adequate access to the installation site. If installation crews arrive and the site is inaccessible, unsafe, improperly prepared, or unavailable for installation, Buyer may be responsible for additional trip charges ($200–$600), mobilization fees, storage fees, or rescheduling fees.

17. Limitation of Representations

No verbal statement, estimate, promise, projection, or representation made by any employee, dealer, contractor, salesperson, or representative shall modify the terms of this Agreement unless confirmed in writing by an authorized representative of AZ Sunset Steel Structures & Carports.
